Kids Express Daycare REBID Sanborn, Iowa CMBA Project No. 24250 Notice of Hearing & Letting 00 11 13 SECTION 00 11 13 - NOTICE OF HEARING AND LETTING A HEARING will be conducted on the proposed plans and specifications, the proposed form of contract and estimated cost for the Kids Express Daycare Renovation REBID, Sanborn, Iowa at Prairie View Nursing Home, Conference Room, 610 Eastern Street, Sanborn, Iowa at 8:30 A.M. on Thursday, July 23rd, 2026, at which time and place any person may appear and file any opinion and express their view to the proposed plans, specifications, form of contract and estimated costs for the Project, both orally and in writing.
SEALED BIDS for a Single Prime Contract will be accepted for the Kids Express Daycare Renovation REBID project at Prairie View Nursing Home, Conference Room, 610 Eastern Street, Sanborn, Iowa, until 9:00 A.M. on Thursday, July 23rd, 2026.
If a bid is to be mailed, the bid envelope shall be sealed in a regular mailing envelope. FAX and E-mail Bids will not be accepted. The bidder shall bear sole responsibility for ensuring any bid is received at the correct bid location and by the correct time. Kids Express Daycare shall have no responsibility regarding the location or timeliness of receipt of any bid. Bids will be publicly opened and read aloud following the closing of the above bid submission deadline.
Each bid shall be accompanied by a bid bond, certified check, cashier’s check or certified share draft in a separate sealed envelope, clearly marked “Bid Bond” or Bid Security”, in an amount equal to five percent (5%) of the total amount of the bid. The certified or cashier’s check shall be drawn on a bank in Iowa or a bank chartered under the laws of the United States of America or the certified share draft shall be drawn on a credit union in Iowa or chartered under the laws of the United States and payable to Kids Express Daycare. Said check or share draft may be cashed, or the bid bond forfeited as liquidated damages in the event the successful bidder fails or refuses to enter into a contract within ten (10) days of issuance of a Notice of Award and post bond satisfactory to the Daycare Board insuring the faithful fulfillment of the contract and maintenance of said improvements as required by law. The bid bond should be executed by a corporation authorized to contract as a surety in the State of Iowa and must not contain any conditions either in the body or as an endorsement thereon. Bids received will be acted upon at such later time and place as may then be established. The successful bidder will be notified after the Daycare Board awards the contract.
The successful Bidder will be required to furnish a Performance Bond along with a Labor and Material Payment Bond in an amount equal to one hundred percent (100%) of the Contract Sum, issued by a responsible Surety approved by the Daycare Board and shall guarantee the faithful performance of the Contract and terms/conditions therein and the maintenance of said improvements pursuant to the provisions of the Contract Documents. All affected sub-contractors shall have arranged for such bond with its surety based upon its bid provided to the Prime Contractor to become part of its bid, on bid day.
Bid Security of two lowest Bidders will be retained until the contract has been awarded and executed, but no longer than 30 days. No Bidder may withdraw his bid within 30 days after opening of bids.

The successful bidder will be notified on or after August 3rd, 2026, after the proposals have been reviewed by the Architect and a recommendation as to the lowest responsible bidder has been made to Kids Express Daycare and accepted by the Board.\
Plans and specifications governing the construction of said proposed improvements have been prepared by Cannon Moss Brygger & Associates, PC, d/b/a CMBA Architects 302 Jones St., Suite 200, Sioux City, Iowa 51101, which plans and specifications referring to and defining said proposed improvements are hereby made a part of this notice and the proposed contract shall be executed to comply therein.\
MANDATORY PRE-BID CONFERENCE will be held at the Project site, PRAIRIE VIEW NURSING HOME, 611 EASTERN STREET, SANBORN, IOWA on June 29th, 2026 @ at 1:00 PM. All interested general (Prime) contractors must attend and sign in; sub-contractors and material suppliers are encouraged to attend as well but are not mandatory. The Owner and Architect will be present to describe the Project and answer questions as well as the CDBG Administrator to review all requirements for the bid documents and grant paperwork.\
Payment will be made by the Owner from CDBG grant funding and from Cash-on-Hand or from other such sources as may be legally available. Monthly estimates will be paid to each Contractor as the work progresses in amounts equal to ninety-five percent (95%) of the Contract value of the work completed during the preceding calendar month, including the actual cost (exclusive of overhead or profit to the Contractor) of materials and equipment of a permanent nature to be incorporated in the work and delivered to and stored at the job site. Such monthly payments shall in no way be construed as an act of acceptance for any part of the work, partially or totally completed. Final payment of the five percent (5%) due each Contractor will be made upon final acceptance of the work under the respective Contract by the Daycare Board, and after receipt of satisfactory evidence that all claims pertaining to such Contract have been paid in full as provided in the Contract Document for said work.\
The work under the Contract is anticipated to commence no later than August 31, 2026, and shall be substantially completed by May 1, 2027.\
This agreement is for services related to a project that is subject to the Build America, Buy America Act (BABA) requirements under Title IX of the Infrastructure Investment and Jobs Act (“IIJA”), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget’s Memorandum M-24-02, Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure. Contractor shall include Manufacturer’s Certification for BABA requirements for all BABA covered items to be incorporated into the infrastructure project. Contractors shall comply with BABA requirements, including coordination with manufacturers, distributors, and suppliers to correct deficiencies in any BABA documentation. For any change orders, Contractor shall provide BABA documentation for any new products or materials required by the change. Contractor shall designate responsible parties for determining the final classifications for all project items.\
All eligible contractors/subcontractors must: Be registered with the Iowa Division of Labor; Meet any and all State licensing requirements (electrical, plumbing, mechanical, etc.); and, be approved by the Iowa Economic Department Authority as not being on the U.S. Department of Housing and Urban Development’s or the U.S. Department of Labor’s list of debarred or suspended contractors. A completed Contractor Eligibility form needs to be submitted with sealed bid to demonstrate currently registered with Iowa Division of Labor.\
The general contractor will be required to enter into a subcontract with each subcontractor performing work on this project and will need to provide a copy of each executed contract to the CDBG Administrator. Each contract shall reference the project, list a detailed scope of work to be performed and list a breakdown of labor, material and/or equipment costs. Each subcontract shall have attached to it all required CDBG contract conditions, provisions, and language (i.e. Section 3 Clause, Required Contract conditions, Federal Labor Contract Provisions, Wage Decision, BABA).\
The Contractor shall observe the laws of the State of Iowa with reference to “Occupational Safety and Health Standards”.\
This project is to be funded in part by a Community Development Block Grant (CDBG) and is therefore subject to certain labor standards and civil rights requirements included in the Contract Documents, including Davis-Bacon. Contractors performing work on the project shall comply with the requirements as enumerated in the applicable statutes and Federal Contract Provisions for CDBG projects. Minimum wage rates to be paid employees have been determined by the U.S. Department of Labor and are listed in the Contract Documents (Wage Decision). The Contractor/Subcontractors will be required to comply with the wage and labor requirements and to pay minimum wages in accordance with the schedule of wage rates.\
Each subcontractor will need to complete a Section 3 Business Certification and an Intent to Comply with Section 3 Requirements and submit with sealed bid.
